NRRI Author Spotlight: Dr. Peter Fox-Penner, Power After Carbon
In this session, utility industry expert Peter Fox-Penner will discuss his new book, Power After Carbon, a sequel to Smart Power. Smart Power introduced the challenges faced by an electric utility industry tasked with reducing its emissions while coping with little or no sales growth, an outdated regulatory and business model, and threats from distributed generation. Power After Carbon continues this exploration by examining the future of electric demand growth and the policies and technologies needed to decarbonize the power sector well before 2050, the latest date consistent with limiting temperature increases to 2 degrees centigrade average. The book also reviews the reforms needed to improve electricity planning, markets, and the distribution utility business model. This book talk will be followed by audience Q and A.
Dr. Fox-Penner is founder and director of the Boston University Institute for Sustainable Energy and Professor of Practice at the Questrom School of Business, where he teaches courses on sustainable energy and electric power. His research and writing interests are in the areas of electric power strategy, regulation, and governance; energy and climate policy; sustainable finance; and the relationships between public and private economic activity. Prior to BU, he served for more than two decades as principal and chairman of the Brattle Group, an economic consulting firm where he remains as an academic advisor. Before this, he served as a senior official at the U.S. Department of Energy and the White House Office of Science and Technology Policy.

Natural Gas Bans
This session continues discussions on natural gas bans at NARUC’s Annual Meeting in San Antonio and this year’s Winter Policy Summit in Washington, D.C. As more towns are considering imposing natural gas bans on new construction, consumers, the industry, and regulators are expected to deal with a new reality. What is the purpose of the gas bans? What benefits do they bring? In the past, we heard from industry and presenters familiar with utility regulation and government on costs and customer choices. This session will acquaint decision-makers with perspectives from experienced speakers and the environmentally focused organizations they represent.

Considerations for Ratepayer-Funded Clean Energy Programs
What is the outlook for states’ ratepayer-funded energy efficiency and clean energy programs in 2020 and the coming years? Tuesday’s General Session will identify how the state of energy markets may impact the power system, greenhouse gas emissions, and customer demand for clean energy investments. This panel will consider the dynamics at the ground level that utility regulators and program administrators should be paying attention to, particularly in the context of Covid-19 and increasing awareness of racial inequity. The panel will explore whether the success of clean energy programs correlates with energy market trends; how utilities’ ability to execute programs has changed; how customers’ ability to make clean energy investments has changed; and, the role of the local workforce in delivering clean energy programs. This panel will also explore equity in the context of utility clean energy programs. Regulators often look to ensure that all customers are able to participate equally, but is that enough? How can we expand our consideration of equity? Finally, regulators and program administrators may want to speculate how the experience of the pandemic could change or accelerate trends in what services customers want from their utility and other energy companies. We cannot predict the future, but unplanned changes in customer demand could have big impacts on the clean energy outlook. This panel will compare and contrast how utilities, regulators, and advocates are planning for an uncertain future, and how each perspective is informed by other stakeholders.

Increasingly, these goals are expanding to target de-carbonization, not just in electricity generation but also in transportation, buildings, and industrial processes. Hydrogen potentially offers a strategic opportunity to achieve these economy-wide clean energy goals cost-effectively. On the supply side, hydrogen production pathways can use existing nuclear, renewable, and natural gas infrastructure to produce a versatile fuel that is well-suited for energy storage. And on the demand side, hydrogen’s ability to reliably generate low-carbon heat makes it an attractive proposition for heavy industrial users looking to reduce costs and emissions. ESG, not as new an idea as you may think. This presentation will briefly explore the hidden history of the ESG (Environment, Social, Governance) concepts dating back to Biblical times and Colonial American, its fringe concept in the second half of the twentieth century in the USA and its emergence in mainstream investing in Europe in the first decade of the twenty-first century. It will also explore how the emergency of the coronavirus (COVID-19) pandemic and Black Lives Matter/social justice movement in 2020 could impact ESG analysis. The presentation will conclude with a summation of the impact of ESG on the public utilities industry and state utility commissions in a rapidly changing world.

Clean Energy in the Time of COVID-19 and Beyond: How Will COVID-19 Change the Ability of Utilities to Meet their Carbon Reduction or Renewable Energy Targets?
Currently, 23 states and the District of Columbia have implemented statewide greenhouse gas targets and 50 utilities have noted carbon or emission reduction goals. Sixty-five percent of customer accounts are served by a utility with a carbon or emission reduction goal. Many factors contribute to the targets set and the efforts to achieve them. How much has changed since March 2020 amid the COVID crisis? Discussion topics will include:
National renewable energy tax incentives — investment tax credit (ITC) and production tax credit (PTC) — are two pieces of the puzzle. How much will expected guidance from the Treasury help to soften the blow from delays?
Before March 2020, clean energy had been one of the U.S. economy’s biggest and fastest-growing employment sectors, growing 10.4 percent since 2015; however, in March and April alone, 600,000 clean energy jobs were lost. How will projects proceed without these workers? What is the renewables (and efficiency) industry doing to stop imminent job losses and get back to work?
Of the 50 utilities with goals, 15 of them have near-term (2025 or earlier) milestones. Are these utilities concerned about their ability to meet near-term targets? Are there emerging opportunities to reach clean energy goals hidden within this pandemic? With lower cost of capital available, lower fuel costs from reduced demand, and potentially lower operating expenses, might utilities be able to overcome the more obvious challenges?

Buyer Beware! Managing Supply Chain Risks in Critical Energy Infrastructure
An executive order issued on May 1, 2020, deemed foreign supply of equipment used on the bulk-power system an unusual and extraordinary threat to the national security, foreign policy, and economy of the United States. The order comes on the heels of mounting evidence that the electric grid has become a target of foreign adversaries looking to inflict catastrophic harm on the nation. Aimed squarely at mitigating weaknesses in often-opaque supply chains, the order limits the use of foreign-sourced equipment and calls for the creation of vendor qualification criteria.
This panel will discuss the impact and implications of supply chain security for the bulk power sector and highlight the potential downstream effects on the distribution grid.

Do electrification plans, and proposed infrastructure investments, adequately reflect the additional demand electrified transportation is expected to place on the grid? How can commissions assess whether charging will put downward pressure on rates?
Commission decisions must be supported by data that are reviewable, appropriate, and reliable. As decisions regarding costs are expected to experience pushback, it is vital that commissions rely on high-quality data that correctly reflect each market. The importance of quality data is further amplified by the fact that commissions will need to develop innovative, and potentially unprecedented, approaches to regulatory decision making in regards to utility proposals to recover electrification-related costs.
This panel will discuss the metrics and data, in general, that are available to utilities and regulators; what data are lacking that should be collected; how to access the data; and, lastly, offer various options on how to evaluate and analyze the date in a way that provides the tools necessary to properly chart the electrification future that lies ahead.

The importance of quality data is further amplified by the fact that commissions will need to develop innovative, and potentially unprecedented, approaches to regulatory decision making in regards to utility proposals to recover electrification-related costs.
This panel will discuss the metrics and data, in general, that are available to utilities and regulators; what data are lacking that should be collected; how to access the data; and, lastly, offer various options on how to evaluate and analyze the date in a way that provides the tools necessary to properly chart the electrification future that lies ahead.

Successes and Challenges — Industry Response to COVID-19 Emergency
In response to COVID-19 and its unprecedented demand for broadband service, the Federal Communications Commission launched the Keep Americans Connected Initiative to ensure that people would not lose their broadband or telephone connectivity during the pandemic. More than 750 communications companies voluntarily agreed to the initiative and many implemented other creative solutions, including increasing or waiving data caps and increasing access to Wi-Fi hotspots. This conversation focuses on the performance of broadband networks under the strain of both increased demand and new patterns of usage and takes a look at how Internet service providers met the challenging service needs of consumers and communities under stay-at-home orders.

Tackling "Forever Chemicals": What are PFAS Contaminants and How Do We Respond to Impending Rulemaking?
A 2019 Environmental Protection Agency Action Plan issued an Advance Notice of Rulemaking for per- and polyfluoroalkyl substances (PFAS). This session will focus on the impending PFAS rulemaking and how public utility commissions can best prepare for regulatory changes. Participants will review the need for PFAS regulation and the current status of regulations at the federal and state levels. Commissioners from states that have implemented PFAS regulation will discuss best practices for adapting to a PFAS regulatory environment. EPA representatives will discuss pending rulemaking processes.

In the face of enormous challenges and uncertainties, the energy world has had to step up and ensure that the power grid remains reliable and resilient. The heart of effective energy leadership in dealing with such a monumental crisis comes down to resiliency. This session will explore how thought leaders have looked to the lessons of the past to help them (and us) move forward through and beyond this crisis. We will examine their personal life lessons to help us truly analyze our own leadership skills necessary to move positively toward true economic regulatory resilience.
