Resolution Concerning Wireless Consumer Complaints

A resolution encouraging wireless telecommunications carriers to hire and train its staff at sufficient levels to render adequate and satisfactory service to consumers. NARUC directs the Committee on Consumer Affairs to pursue a study that would identify the extent and type of consumer complaints filed against wireless carriers. NARUC directs the Staff Subcommittee on Consumer Affairs to explore options, with the Consumer and Governmental Affairs Bureau of the FCC and the wireless industry, to facilitate speedy and fair resolution of wireless consumer complaints, including those received by state commissions.

A resolution encouraging all wireless carriers to implement number portability prior to the November 24, 2003 date imposed by the FCC. NARUC encourages the FCC to obtain frequent status reports from the wireless industry and its vendors concerning its preparations to meet the FCC deadline, with particular attention to the question of preparedness of sales and service personnel to implement wireless number portability, and to the progress being made by small wireless providers in preparing to implement wireless number portability.

A resolution supporting continued funding and advanced funding for LIHEAP. NARUC also urges the President to release to the States the full $600 million in LIHEAP emergency funding to address additional heating and cooling needs in FY 2002. NARUC urges the Congress to appropriate adequate LIHEAP funding for FY 2003, in an amount not less than the $2.3 billion released in FY 2001 and approved by Congress for FY 2002 including emergency funds.

A resolution requesting that the FCC to establish a Federal-State Joint Conference to develop comprehensive accounting and reporting changes, under Section 410(b) of the 1996 Telecom Act, to ensure a fully developed record. States and territories are encouraged to file comments responding to the FCC's sunset proposals by identifying those specific rules which should not be sunset and providing a full analysis of the justification for the rules, on a rule-by-rule basis and addressing the advantages and disadvantages of a sunset approach, as opposed to concluding that requirements should be eliminated only upon meeting certain conditions with the development of a competitive marketplace.

CYBER DIALER ATTACKS Issue Paper

A Paper discussing possible actions for regulatory attention regarding “cyber dialer attacks” Long distance carriers should be required to offer blocking of international calls blocking of 1010288 011 calls or provide ID and PIN protection to make long distance and international calls. Customers should not have their local service or credit rating affected if they have one of these charges in dispute. Develop State and federal rules/laws prohibiting the transfer of dialing programs via the Internet or email and to dial a customers computer to international locations without prior written contracts. Require all long distance carriers to provide to all customers’ information explaining this problem and how to prevent it from occurring.
